I am selling the business
The sale of your business could affect your training contract with your apprentice or trainee, depending on whether the legal name of the employer is changed.
Legal name not changed
When you can sell the business and the business (legal) name the training contract is unaffected if the apprentice or trainee is to continue their employment with the business.
Legal name changed
The training contract is no longer valid if
- the business is sold
- the new owner registers the business with a different legal name
- and the apprentice or trainee remains.
The options become
- Arrange a transfer of the training contract, or
- cancel the training contract and the new owner can create a new one or
- cancel the training contract if the new owner terminates the apprentice or trainee.

Note: if the training contract is cancelled and the apprentice/trainee is terminated the continuing Apprentices Placement Service (CAPS) may be able to assist finding another similar position.
